1. Agreement

These Terms and Conditions govern access to and use of Calm & Vital Life, comprising the website at calmandvitallife.com, the newsletter and the RSS feed (“the Review”), operated under that trade name by its publisher (the “Publisher”). Use of the Review constitutes acceptance of these Terms and of the Privacy Statement. An Observer who does not accept them must not use the Review. Use is limited to persons aged 18 or over.

2. Editorial Standards and Sources

The Review aims to translate published research on sleep, hormones, gut health, nutrition and longevity into plain language. Articles cite sources where practicable. Research evolves; findings summarised in the Review may later be revised, contradicted or superseded, and the Publisher does not undertake to update every article.

3. No Medical Advice

THE REVIEW IS AN EDUCATIONAL PUBLICATION. IT DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS OR TREATMENT AND IS NOT A SUBSTITUTE FOR CONSULTATION WITH A PHYSICIAN OR OTHER QUALIFIED HEALTH PROFESSIONAL. DO NOT START, STOP OR CHANGE ANY MEDICATION, SUPPLEMENT, DIET OR TREATMENT ON THE BASIS OF THE REVIEW. IN AN EMERGENCY, CALL 911. IF YOU ARE IN CRISIS, CALL OR TEXT 988.

Reading the Review does not create a clinician–patient or other professional relationship between the Observer and the Publisher or any contributor.

4. Subscriptions

4.1 Free newsletter

The newsletter is provided free of charge and may be cancelled at any time through the unsubscribe link.

4.2 Gift and paid subscriptions

If the Publisher offers gift subscriptions or paid tiers, the price, billing interval, renewal and cancellation terms will be presented before purchase and will form part of these Terms. Any automatically renewing subscription will be disclosed clearly before the Observer agrees to it, with a simple way to cancel.

5. RSS Feed

The RSS feed is licensed for personal reading in a feed reader. It may not be republished, aggregated into a commercial service or displayed on another website without written permission.

6. Intellectual Property

All articles, headlines, illustrations, data visualisations, logos and the trade name Calm & Vital Life are owned by or licensed to the Publisher. Observers may view and share links to the Review and quote brief excerpts with attribution and a link. Any other reproduction, distribution, adaptation, framing or use for training machine-learning systems requires prior written consent.

7. Observer Conduct

Observers must not use the Review unlawfully; interfere with its operation or security; use automated means to access or copy it; misrepresent their identity; or submit material that is defamatory, infringing or harmful.

8. Corrections

The Publisher welcomes reports of factual errors at support@calmandvitallife.com. Corrections are assessed under the Publisher’s editorial standards, and where an error is confirmed the article is amended with a note. Submitting a correction grants the Publisher the right to use its substance without obligation.

9. Third-Party Content and Links

The Review may link to studies, journals and other websites. The Publisher does not control and is not responsible for third-party content, and a link does not imply endorsement.

10. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE REVIEW IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY AS TO CURRENCY, COMPLETENESS, TITLE, QUIET ENJOYMENT, SATISFACTORY QUALITY, ABSENCE OF INFRINGEMENT OR SUITABILITY FOR ANY PURPOSE.

11. Limitation of Liability

“The Editorial Group” means the Publisher and its editors, contributors, reviewers, contractors and agents.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE EDITORIAL GROUP SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY HARM ARISING FROM RELIANCE ON CONTENT IN THE REVIEW. THE AGGREGATE LIABILITY OF THE EDITORIAL GROUP SHALL NOT EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (US$100) OR THE AMOUNT, IF ANY, PAID BY THE OBSERVER TO THE PUBLISHER IN THE SIX MONTHS PRECEDING THE CLAIM.

12. Indemnification

The Observer shall indemnify and hold harmless the Editorial Group against claims, losses and expenses, including reasonable attorneys’ fees, arising from the Observer’s breach of these Terms, misuse of the Review or infringement of any third-party right.

13. Dispute Resolution

13.1 Notice and informal resolution

A party with a dispute shall send written notice describing it to the other party (to the Publisher at support@calmandvitallife.com). The parties shall attempt to resolve the dispute informally for 60 days.

13.2 Binding arbitration

Unresolved disputes shall be finally determined by a sole arbitrator in proceedings administered by the American Arbitration Association pursuant to its Consumer Arbitration Rules, each claim being heard individually. Hearings shall take place by videoconference unless the arbitrator orders otherwise. Small-claims matters are excluded.

13.3 Coordinated filings

If 25 or more similar demands are filed by or with the assistance of the same counsel or coordinated counsel, they shall be administered in batches of no more than 50, with the remaining demands held in abeyance and limitation periods tolled until each batch is resolved.

13.4 Class waiver

Disputes shall be resolved only on an individual basis. Class, collective and representative proceedings are waived.

13.5 Opt-out

The Observer may elect to be excluded from this section by delivering written notice to support@calmandvitallife.com no later than thirty (30) calendar days after first accepting these Terms.

14. Governing Law and Forum

The construction, validity and performance of these Terms shall be determined under the federal law of the United States of America, to the exclusion of any conflict-of-laws doctrine. Subject to the Dispute Resolution section, exclusive jurisdiction is vested in the United States district courts having jurisdiction over the matter.

15. General

These Terms and the Privacy Statement constitute the entire agreement regarding the Review. If any provision is held unenforceable, the remainder continues in force. No failure to enforce a provision is a waiver. The Publisher may assign these Terms. Provisions which by their nature should survive termination shall survive. The Publisher may amend these Terms by posting a revised version with a new effective date.
